CTG recruit and manage qualified, skilled teams with extensive experience operating in challenging conditions.Overview of positionThe Government of Somaliland through the Ministry of Finance has requested the World Bank to support the preparation and implementation of the Towage Services in Berbera Port Project. The 2013 SEA of Berbera Port identified the need for urgent improvements and investments in the port, including replacement of the current tugboat to ensure the continuity of the port to handle domestic demand and transit volumes. The tugboat is more than 40 years old and has passed its economic lifetime, which for tugboats generally is 20 years. The tugboat is not in operation for a large part of the year due to maintenance and repairs. The low tugboat capacity (1,500HP) is a strict constraint on the overall capacity of the port and for the kind of vessels that are able to call at Berbera. Acquisition of the tugboat is regarded as critical in order to reduce the risk of inoperability, which could have disastrous consequences for the port. The current tugboat will be replaced with one large tugboat to allow for better maneuverability to assist larger vessels (bulk ships) to call the port and increase port capacity. GoSl has made a formal request to the Task Team to finance the tugboat purchase.Role objectives- Project Development Objective is to support the development of the Berbera Port by improving throughput, towage capacity and reliability of towage services.
The project will comprise of two components:
Component 1: procurement capacity support to the Berbera Port Authority and
Component 2: Tugboat Replacement.
This component will enable acquisition of a tugboat through direct financing of the equipment. Additional financing already secured and made available as part of Somalia Private Sector Development Re-engagement Phase II program (Som-PREPII) will support comprehensive technical assistance to draft technical specifications for the procurement of the tugboat. The Project is expected to modernize port operations as well as increase accessibility and promote access to regional and foreign trade for the Somaliland economy through the local and international transport network.
The tugboat replacement is considered an initial and essential step in the modernization of Berbera Port. The total (direct and indirect) job effect of equipment modernization is estimated at 1,100 jobs by 2018. The 1,100 jobs are the result of the increase in volume of an approximate 830,000 tons that can be handled in the port as a result of modernization. The current tugboat has a lot of downtime, which discourages shipping lines and neighboring markets from using it, and thereby significantly impedes trade port and regional integration.
Government has submitted a formal request to the Bank to review and grant no objection for contract negotiations with the lowest evaluated responsive bidder on the basis of the bid analysis report prepared by Government. It has demonstrated in the Analysis Report that an opportunity exists to involve in a negotiation process to achieve reduction in the final price for the Tug Boat.
The process and outcome of negotiations is aimed at arriving at a satisfactory contract in line with the Bank Procurement Guidelines, Clauses in paragraph 2.63 and 2.64 which permit negotiations with the lowest evaluated bidder to obtain a satisfactory contract through reduction in scope or through reallocation of risks and responsibilities which can be reflected in the reduction of the contract price.
Thus, the BPA is desirous to obtain the services of an individual probity assurance provider (PAP) to satisfy the requirements of probity in a contract negotiation process to assure the integrity of the procurement decision making process.
The immediate objectives of the assignment are to ensure that BPA has a probity plan for the contract negotiations and that there is an assurance of the adherence to the probity plan.Expected output- Based on the requirements of the Bank procurement guidelines, the bidding document, the M/s Holland Shipyard bid, the Bid Evaluation Report, and the proposal to negotiate, prepare a probity plan. This should cover the process from contract negotiations to contract completion following delivery and final payment.
A Probity Plan for the contract for the supply of a tug boat to BPA. The plan should identify the probity risks and related mitigations including the role and responsibilities of BPA and the Bidder in responding to the risks.
Prepare a detailed guidance on how probity issues should be addressed and any anticipated problems that may arise and courses of action to be taken.
Include in the probity plan a description of how the probity audit will be conducted. It should be noted that the responsibility for probity remains with BPA and will under no circumstances transfer to the PAP.
To be present during the negotiation, with a view to observe that the negotiation is taking place in the manner decided as per the probity assurance plan.
The Probity Audit will provide an independent scrutiny of the contract negotiation and signature process and express an objective opinion as to whether the prescribed probity requirements have been adhered to. The conclusion expressed should be based on evidence gathered against criteria agreed in advance with BPA.
Key elements of the audit will include:
- Criteria:- Agree with BPA a set of predetermined benchmarks to be used to measure and evaluate whether the probity requirements within the procurement process have been met. Then use the criteria to establish the actions to be taken for audit investigation and assessment.
- Evidence:- Obtain sufficient, appropriate evidence for each established criterion so that the PAP’s decision is supported by robust facts and documentary evidence.
- Report:- Provide the results and opinion on the probity of the contract negotiation and signature as to whether the probity requirements were met and include any significant issues that have been identified and that impact upon the opinion providedProject reporting- Probity Plan for the contract for the supply of a tug boat to BPA (within one week of commencement of the assignment)
- A Probity Audit Report (within one week of the completion of negotiation process)Key competencies The PAP must be an experienced, qualified and reputable Probity Auditor who is familiar working in the private sector and preferably with the shipbuilding Industry.
